Babalola vs Farotimi Case: When Defamation Raises Crucial Questions About Justice in Nigeria

It is the case between Aare Afe Babalola, a prominent jurist and Advocate of the Nigerian Bar, and Dele Farotimi, who accused him of defamation over a land dispute that was over two decades old.

It all started when a lawyer in Babalola’s law firm discovered defamatory allegations against him, his law firm Afe Babalola & Co, and his colleagues Olu Daramola SAN and Ola Faro, in the book “Nigeria and Its Criminal Justice System” written by Dele Farotimi. The charges relate to a Supreme Court judgment in a land dispute dating back to 2005.

Following the discovery, police arrested Dele Farotimi at his office in Lagos and took him to Edo Ekiti, the capital of Ekiti State. The arrest sparked a wave of reactions on social media, with many Nigerians, including politicians, expressing concern over a possible attempt to muzzle freedom of expression and abuse of power by the police.

Human rights lawyer and activist Dele Farotimi was charged before the Ekiti Magistrate’s Court with defamation and cyberstalking. Despite his application for bail, the magistrate ordered his detention in a correctional facility pending a hearing date scheduled for December 10.

In his letter to the Commissioner of Police in Ado-Ekiti, Aare Afe Babalola detailed the course of the land dispute between the parties and the outcome of the case before the Supreme Court. He highlighted the defamatory statements made against him in Dele Farotimi’s book, highlighting the legal implications of such accusations.

This case, beyond the initial land dispute, highlights the issues of freedom of expression, the limits of defamation and the balance between individual rights and societal responsibility.
