The R1.2 billion tender controversy: questions of fairness and transparency in public tenders


The recent controversy surrounding the R1.2 billion tender awarded by the State Information Technology Agency (Sita) to the Blue Network Consortium to expand internet services to schools in the Western Cape has sparked a controversy that has highlighted questions about the transparency and fairness of public tenders.

Despite the revelations of irregularities highlighted by a forensic investigation report by Cliffe Dekker Hofmeyr (CDH), the Western Cape Department of Education has indicated its intention to continue to honour the contract with the consortium, arguing that there are no valid legal grounds for its cancellation at this time.

The CDH report highlighted several irregularities, including the submission of two price options by the Blue Networks consortium, the disqualification of Dimension Data and shortcomings in the tender approval process by the Sita board. These elements raise concerns about the fairness and competitiveness of the bidder selection process.

Tendai Jangara, director and head of the law firm’s corporate investigations team, pointed out that Blue Networks’ evaluation of two price proposals would have made the tender process unfair, as the bidder’s terms were unclear about the possibility of submitting multiple price options.

Despite CDH’s findings, the province has dismissed the allegations of irregularities and said it did not affect the mandate of the education department. Still, Sita has called on the Special Investigation Unit (SIU) to conduct a thorough investigation, stressing that the size of the funds involved requires careful verification.

This case highlights the challenges faced by public administrations in procurement and underlines the critical importance of transparency and fairness in tendering processes. Ensuring that such incidents do not compromise the integrity and legitimacy of public contracts is essential to preserving citizens’ trust in government institutions.
