At the heart of a controversy over the origin of the Constitution of the Democratic Republic of Congo (DRC), the debate has rebounded following the statements of President Félix Tshisekedi. According to the Center for Research and Studies on the Rule of Law in Africa (CREEDA), the Head of State’s statements do not correspond to historical reality.
CREEDA emphasizes the crucial aspect of the place where the Constitution in question was drafted. Indeed, it was in Kisangani, in a Center for Catholic Priests, that the drafting process of the first draft of the preliminary draft of the Constitution of the Third Republic took place. A Constitutional Commission composed solely of Congolese senators worked on this document, supported by a committee of Congolese experts.
The NGO recalls that this drafting work was done in accordance with Article 104 of the Transitional Constitution, which tasked the Senate with developing the preliminary draft of the Constitution to be submitted to a referendum. This initial version was then amended, discussed within the Senate and the National Assembly before being adopted and submitted to a popular vote in December 2005.
Although President Tshisekedi advocates for a revision of the Constitution in order to adapt it to the current realities of the country, CREEDA insists on the importance of respecting the heritage and the initial drafting process. For the NGO, it is essential to preserve the fundamental principles and values on which the Congolese Constitution is based.
