Fatshimetrie recently covered the case of a naira abuse incident that resulted in a six-month prison sentence. The accused, Okuneye, pleaded guilty to four counts related to the abuse of the naira, as confirmed by the Economic and Financial Crimes Commission (EFCC) during the court proceedings.
Judge A.O. Awogboro of the Federal Court of Lagos handed down a clear judgment, sentencing Okuneye to six months in prison with no possibility of remission. The aim of this conviction, which cannot be appealed, is to deter any future instances of naira abuse or mutilation.
Despite this verdict, Okuneye’s lawyer, Mr. Bimbo Kusanu, has filed an appeal seeking a reduction in the sentence. He has requested the Court of Appeal to replace the prison term with a ₦50,000 fine for each charge.
Mr. Kusanu argues that the court’s maximum sentence is disproportionate, especially considering Okuneye’s clean criminal record. He believes that under the Administration of Criminal Justice Act (ACJA), less severe sanctions could have been explored.
Additionally, Mr. Kusanu points out that the court did not adequately consider Okuneye’s positive background, quick admission of guilt, and cooperation with the authorities from the start of the investigation. He also criticizes the court for what he perceives as a lack of fair discretion in the sentencing process.
This case highlights concerns about the fairness and proportionality of sentences within the justice system. It underscores the importance of delivering justice equitably, taking all relevant factors into account to ensure just and balanced outcomes.
