**Justice I.A Jamil issues decision in case HCL/68/M/2020 in Lokoja**
In a significant ruling after a two-hour deliberation, Justice I.A Jamil pronounced judgment in the case HCL/68/M/2020 in Lokoja on Wednesday.
The judge emphasized that encroaching on the fundamental rights of the former Kogi governor is illegitimate unless explicitly sanctioned by the court.
“By this ruling, the EFCC is prohibited from apprehending, detaining, and prosecuting the applicant. This decree serves as a final directive subsequent to the initial injunction granted,” he articulated.
Bello lodged a grievance alleging the infringement of his fundamental rights by the state’s anti-graft agency in the High Court. The former governor petitioned for a directive restraining the EFCC from wrongfully arresting, detaining, and prosecuting him.
Seeking safeguarding of his fundamental rights against the EFCC, the court commanded the respondents to desist from pursuing the petitioner unless equipped with substantial evidence following a thorough investigation.
Addressing the jurisdictional objection raised by the EFCC, the judge disclaimed the objection, deeming it unsuccessful.
“This esteemed court possesses the rightful authority to assess this plea. Therefore, the issues regarding the applicant’s fundamental human rights have been satisfied,” he declared.
This verdict signifies a pivotal moment in the case, emphasizing the paramountcy of safeguarding the fundamental rights of every individual, even in the face of influential government and judicial bodies. This case underscores the necessity of an autonomous and impartial judiciary to uphold justice for all.
