The case involving AFDC-A lawyers and the Constitutional Court has stirred up considerable controversy surrounding the validity of the 2023 national legislative election results. The AFDC-A legal team strongly disputes the annulment of six national deputy members from their political group, arguing that the Constitutional Court erred by equating vote discrepancies with instances of fraud.

Jean-Claude Phukuta, representing AFDC-A, asserts that the Constitutional Court overstepped its authority by adjudicating fraud cases that were not initially reported by CENI, the sole authorized body to investigate such irregularities. He maintains that confirmed instances of fraud had already been dealt with by the Constitutional Court, resulting in the disqualification of the implicated candidates.

Central to the debate are the principles of transparency and integrity in the electoral process, as well as the judiciary’s competence in resolving electoral disputes. The Constitutional Court states that it internally processes requests received at its registry without specifying if they will be reviewed by a designated chamber. Over a hundred and ten appeals challenging the outcome of the 2023 national legislative elections have been lodged.
