Divorce and child custody: The legal battle for the well-being of the child

In a recent court case, a complainant told the judge that her estranged husband, Abubakar Ishaq, took their child to his mother after their divorce in 2020.

She told the court that her former husband allowed her to see their daughter once a year.

“There is no hope of reconciliation between my estranged husband and my guardian; in fact, it was my guardian who gave me permission to come to court,” she said.

For his part, the defendant, through his lawyer, Rabiu Muhammad, claimed that the plaintiff left their child in his hands after their separation.

“I gave my daughter to my mother to take care of,” he said.

“My mother gave her back to me when I remarried and I enrolled her in school.

“My former wife only started looking for our daughter when my second marriage failed,” he added.

He also claimed that during a reconciliation meeting with his former wife, his guardian asked him to keep the child for some reasons which he could not mention in court.

“We are ready to present him in court to testify in this matter,” he said.

The judge, Malam Anass Khalifa, emphasized that in divorce and child custody cases, the welfare of the children is the priority.

He urged parents to maintain peace to ensure the well-being of their children.

This case highlights the challenges many parents face after divorce when the question of child custody arises. The protection of the child must always be the primary concern of all parties involved.
