Constitutional Court considers Mike Mukebayi case: crucial decision awaited
The provincial deputy and executive of the political party Ensemble pour la République, Mike Mukebayi, impatiently awaits the verdict of the Constitutional Court. After four months of waiting, the public hearing which will be held this Friday, November 10 will decide the fate of this political opponent incarcerated since May 23.
For Mike Mukebayi’s lawyers, his arrest is a political maneuver aimed at silencing him. According to them, this case lacks legal basis and is more akin to political persecution. The request for unconstitutionality introduced by the provincial deputy will therefore be carefully examined by the Constitutional Court in order to establish whether or not the rights of Mike Mukebayi have been violated.
Mike Mukebayi’s arrest follows his support for the family of a minor child victim of violence during an opposition demonstration led by Martin Fayulu, Moïse Katumbi, Matata Ponyo and Delly Sesanga. These demonstrations, which took place on May 20, were brutally repressed by law enforcement and security forces, causing numerous damages and injuries.
The fact that the Constitutional Court has delayed issuing its judgment since June 1 leaves doubt about the real objective of Mike Mukebayi’s incarceration. The provincial deputy’s lawyers also wrote to the President of the Court to obtain information on the status of the objection of unconstitutionality raised.
This case illustrates the political tensions that persist in the Democratic Republic of Congo. Opponents of the regime in place are often victims of persecution and arbitrary arrests, a situation which endangers democracy and human rights in the country.
The decision of the Constitutional Court will therefore be eagerly awaited, not only for Mike Mukebayi and his lawyers, but also for the entire Congolese population who hope for real justice and respect for fundamental rights. It is essential that the Congolese authorities guarantee a stable political climate that respects human rights, thus promoting genuine dialogue and democratic participation.
This Friday, November 10, will therefore mark a significant turning point in the Mike Mukebayi affair and will have repercussions on the political situation in the Democratic Republic of Congo. The question that arises is whether justice will be truly impartial and whether the rights of Mike Mukebayi, as well as those of all Congolese citizens, will be respected. The answer will depend on the decision of the Constitutional Court.
