Review of the article: Mining royalty and reparation for the victims of the Congolese genocide: a step towards justice and reparation
The Democratic Republic of Congo (DRC) recently adopted a draft decree aimed at specifying the methods for collecting and distributing mining royalties. This historic decision aims to ensure that the victims of the Congolese genocide obtain the reparation and justice that they deserve. The draft decree was examined by the Deputy Minister of Mines, Godard Motemona, and adopted during the 108th Council of Ministers held in Kinshasa.
According to the provisions of the law in force, the text establishes a fund responsible for supporting access to justice, reparation, empowerment and community recovery for victims of the Congolese genocide and their dependents. This fund, called the National Fund for Reparations for Victims of Conflict-Related Sexual Violence and Victims of Crimes Against the Peace and Security of Humanity (FONAREV), will receive a share of 11% of the mining royalties paid by the holders of mining titles.
The report of the meeting of the Council of Ministers specifies that this share will be deducted from the quotas of the beneficiaries provided for by article 242 of the Mining Code, at the rate of 6% on the quota due to the State, 2% on the portion due to the province, 1% on the portion due to the decentralized territorial entity and 2% on the portion due to the Mining Funds for future generations. These methods of collection and distribution of mining royalties are in accordance with the fundamental principles of protection and reparation for victims of sexual violence linked to conflicts and crimes against the peace and security of humanity.
By adopting this draft decree, the government of the DRC demonstrates its determination to fight against impunity, to promote human rights and to actively support the victims of violence. President Félix Tshisekedi has expressed his desire to ensure that the structures in charge of reparation have the material and human resources necessary to fulfill their mission. This initiative marks an important step in the efforts of the DRC to guarantee reparation and justice to the victims of the Congolese genocide.
August 2 was dedicated to the commemoration of the Congolese genocide, and on this occasion, President Tshisekedi insisted on the implementation of the decision of Parliament concerning the payment of mining royalties. This measure aims to ensure that the profits from mining actually contribute to reparation for the victims and to supporting them towards a better future.
