The long soap opera of the taking hostage of Claudine Masamba’s heritage by her brothers continues to fuel discussions at the Tribunal de Grande Instance of Kinshasa/Matete. Since December 2022, this case of fraudulent sale of an estate property continues to experience twists and turns.
Claudine Masamba, dissatisfied with the illicit sale of the plot located at number 1283 avenue de la Poste in Kinshasa, turned to justice to assert her rights as heiress. She is asking both to be reinstated in her rights to the sale and to obtain release from joint ownership. However, the legal file seems to be blocked, due to delaying maneuvers on the part of his brothers.
The case has experienced several postponements and difficulties in the seizure procedure of the brothers residing abroad. After months of hesitation and complications, the parties finally seem to be seized by the Tribunal de Grande Instance. However, new elements are further complicating the situation.
During the hearing on April 18, 2023, it emerged that one of Claudine Masamba’s brothers, Remy Masamba, claimed not to have been properly seized, although he was reached after several months of searching. In addition, during the hearing on July 18, 2023, Alidor Masamba brandished a notice of appeal from the Kinshasa / Matete Court of Appeal, questioning his referral by the court.
All these adventures give Claudine Masamba the impression of being prevented from leaving joint ownership and seeing her share of the inheritance blocked by her brothers. She also suspects the existence of maneuvers aimed at selling off the property of the Masamba estate. This unfair situation is shaking the reputation of the Masamba family, long respected for the achievements of patriarch Simon Masamba Makela.
Faced with these obstacles, Claudine Masamba sought the help of Congolese institutions to assert her rights. She does not intend to be intimidated and wishes to lead this case to its conclusion.
It is important to emphasize that each party has the right to defend themselves and to put forward their arguments within the framework of justice. However, it is essential that this case be handled in accordance with legal procedures and that the truth can finally come out.
In conclusion, the case of the fraudulent sale of an estate by Claudine Masamba and her brothers continues to attract attention at the Tribunal de Grande Instance of Kinshasa/Matete. The many twists and turns and delays surrounding this case raise questions about the search for the truth and the protection of the rights of heirs. It remains to be hoped that justice can be rendered in accordance with the law and the principles of fairness
