The rule of law in the Democratic Republic of Congo: a challenge for justice
Since coming to power more than four years ago, President Félix Tshisekedi has set himself the goal of reforming justice in the Democratic Republic of Congo and promoting the rule of law. However, despite its efforts, this concept symbolizing justice reform is struggling to take root and produce the expected results.
In a recent interview, President Tshisekedi expressed his disappointment with his government’s record on justice. He believes that this is destroying the country rather than raising it, and deplores the lack of understanding and collaboration of the heads of judicial institutions. The president also defends himself from accusations of instrumentalization of justice for political purposes, claiming not to intervene in judicial decisions and wishing that justice remain independent.
However, the dysfunctions of Congolese justice are obvious. Judicial decisions seem to be made haphazardly, thus arousing public distrust of the judicial system. President Tshisekedi himself recognizes that justice is often perceived as a “stations of the cross” for litigants.
Faced with this situation, President Tshisekedi called for reforms within the Superior Council of the Judiciary, responsible for the regulation and discipline of magistrates. He also asked the General Inspectorate of Judicial and Penitentiary Services to play a more effective role in supporting the Ministry of Justice.
However, implementing these reforms will not be easy. It will require close collaboration between all players in the judicial system, as well as sufficient financial and material resources to guarantee its proper functioning.
It is also crucial to promote the independence of the judiciary in order to ensure impartial and fair justice for all Congolese citizens. This requires respect for the fundamental principles of the rule of law, such as the separation of powers and fair access to justice for all.
In conclusion, justice reform and the promotion of the rule of law remain major challenges for the Democratic Republic of Congo. President Tshisekedi recognizes the weaknesses of the judicial system and the need for reforms, but their effective implementation will require strong political will and sustained commitment from all actors concerned. Only independent and fair justice can contribute to the growth and development of the country
