The rule of law in the Democratic Republic of Congo: persistent challenges

Since coming to power more than four years ago, President Félix Tshisekedi has placed justice reform at the heart of his political program. However, despite its stated will, the rule of law is struggling to impose itself in the country.

In a recent interview, the Congolese Head of State expressed his frustration with the record of justice under his tenure. He deplores the harmful influence of corruption and political interests on the judiciary, which prevents the establishment of an independent and impartial judiciary. Despite his efforts to make his vision heard by the heads of institutions, he finds that mentalities remain frozen and that justice continues to destroy rather than elevate the nation.

Criticisms of the instrumentalization of justice are increasing. The President is accused of using arbitrary arrests to silence dissenting voices and political opponents. However, he denies any involvement in these cases and highlights his wish to see justice act independently.

But judicial decisions themselves often seem to lack consistency and transparency. President Tshisekedi points to the random and theatrical nature of certain decisions, which fuel mistrust between the people and justice. It therefore calls for reforms to remedy these dysfunctions, both at the level of criminal, civil and administrative justice.

In his desire to strengthen public governance and the rule of law, President Tshisekedi also called on the Superior Council of the Judiciary to assume its responsibilities in terms of regulation and discipline within the judiciary. He wants judges to work efficiently and impartially, while respecting their constitutional independence.

The President also highlights the role of the General Inspectorate of Judicial and Penitentiary Services to support the Ministry of Justice and ensure the proper functioning of the judicial system.

It is clear that the road to a strong rule of law in the Democratic Republic of Congo is strewn with pitfalls. The reforms needed to restore public confidence in justice are numerous and complex. But despite criticism and obstacles, President Félix Tshisekedi remains determined to continue his efforts to bring about a fair, transparent and impartial judicial system.

The defense of the rule of law remains a major challenge for the country, and this cannot be done without a strong and independent judiciary. Let’s hope that the reforms undertaken will bear fruit and that the Democratic Republic of Congo will finally be able to enjoy justice at the service of the people
