The Suminwa Tuluka government recently approved a bill authorizing the government of the Republic. This decision was taken during the 25th meeting of the Council of Ministers held on Friday, December 6, 2024 at the African Union City. This bill aims to empower the government to take measures within the domain of the law during the parliamentary recess period, which will begin after December 15, 2024. This approach is motivated by the need to act quickly in the face of certain emergencies and in order to respect the parliamentary calendar.
Article 129 of the Constitution constitutes the basis of this enabling bill. This authorises the government, for the urgent implementation of its action programme, to request authorisation from the National Assembly or the Senate to take measures normally falling within the scope of the law by decree-law, and this for a limited period and on specific matters.
Under Article 115 of the Constitution, the National Assembly and the Senate hold two ordinary sessions each year: the first from 15 March to 15 June, and the second from 15 September to 15 December. Thus, the government wishes to be able to legislate on subjects deemed important during the upcoming parliamentary recess period.
This approach, although based on a specific procedure, underlines the importance of the government’s responsiveness and capacity to respond to current issues and challenges of governance. It also demonstrates the authorities’ desire to put in place mechanisms for effective and efficient management of public affairs.
