“Analysis of electoral disputes in the DRC: challenges for democracy and fairness”

The observation of the disputes over the legislative elections in the Democratic Republic of Congo has recently sparked debates and questions within civil society. The Electoral Observation Mission (MOE) Citizen View recently reported its observations during a press briefing which took place on March 18.

The EOM highlighted the significant number of deputies invalidated by the Constitutional Court, particularly young candidates, while certain more established political figures saw their elections confirmed. This situation has raised concerns about fairness in the handling of electoral disputes.

One of the salient points of the EOM’s intervention was the need for candidates to be able to exercise their right of appeal in the event of material errors in the decisions of the Constitutional Court. However, the difficulty for some candidates in obtaining the necessary documents to file their appeal was highlighted, thus hindering their ability to defend their rights.

The Observation Mission also highlighted the non-compliance with certain legal provisions by the CENI and the Constitutional Court, thus affecting the rights of the contested candidates. She called for greater transparency in the publication of the Court’s decisions and for fair and equitable treatment of appeals for rectification of material errors.

Despite these challenges, the EOM welcomed the presence of representatives of all parties to the disputes before the Constitutional Court. The observation work carried out by Regard Citoyen made it possible to closely monitor the progress of appeals and contribute to guaranteeing a democratic and transparent electoral process.

It is crucial to underline the importance of such observation missions to promote democracy and the rule of law in a country like the DRC. The recommendations made by the EOM aim to strengthen citizens’ confidence in the electoral process and to guarantee respect for the rights of all actors involved.
