News: The Council of State examines the appeals of candidate deputies in the elections

On Wednesday, January 10, the Council of State began the investigation of 39 cases relating to the cancellation of the votes and ballots of 82 candidate deputies in the legislative, national, provincial and municipal elections. Among these 82 candidates, 16 of them appealed to the judge for interim relief against the Independent National Electoral Commission (CENI), accusing the latter of having violated their right to defense.

These candidate deputies claim to have been unfairly incriminated by the CENI, which allegedly canceled their votes without having heard them first. They believe that the CENI, as an administrative body, should have invited them to present their defenses on the accusations brought against them, such as fraud, corruption, vandalism and illegal possession of electoral materials.

At the same time, another group of candidates appealed to the Constitutional Court to denounce the unconstitutionality of the CENI’s decision. According to them, this decision would violate the law in force.

The same Wednesday, at least 11 chambers of the Council of State held closed hearings to examine these cases. Some of them have already taken cases under advisement, and verdicts are expected in the coming days.

This situation raises important questions about respect for the rights of candidates and the electoral process as a whole. The decisions of the Council of State and the Constitutional Court will have a significant impact on the political future of the candidates concerned and on the validity of the elections in the constituencies concerned.

It therefore remains to closely monitor the development of these cases and the decisions that will result from them. In all cases, it is essential that the democratic principles and fundamental rights of candidates are respected to ensure the integrity and legitimacy of electoral processes.
