Rehabilitation of Godé Mpoy: A new decision of the Court of Appeal of Kinshasa/Gombe

In a recent decision, the Kinshasa/Gombe Court of Appeal reinstated Godé Mpoy as President of the Kinshasa Provincial Assembly (APK). This decision was made when Godé Mpoy was supposed to be on intellectual rest for 45 days, according to his attending physician.

However, this rehabilitation is not unanimous among the elected representatives of Kinshasa. Indeed, during the motion for forfeiture initiated by the provincial deputy Désiré Mbonzi wa Mbonzi and five other elected officials, Godé Mpoy had not been able to present his means of defence. Therefore, elected officials believe that Godé Mpoy must provide evidence of his ability to assume his duties before returning to his post.

Moreover, the correspondence sent by Godé Mpoy to Francis Tshibalabala, interim president of the APK, did not include the judgment of the Court of Appeal rehabilitating him. Likewise, the Court has not yet officially notified the APK office of this rehabilitation, which raises doubts about the validity of the decision.

In response, Francis Tshibalabala stressed in his correspondence that the APK is not aware of the Court’s judgment rehabilitating Godé Mpoy and therefore does not have the authority to send him the files of the Assembly. . In addition, he recalls that Godé Mpoy is supposed to be on intellectual rest for 45 days, according to his own statement.

It is clear that the Godé Mpoy soap opera is far from over. Kinshasa’s elected officials are awaiting concrete proof of Godé Mpoy’s ability to assume his duties before officially reinstating him in his post
