The Rule of Law in the Democratic Republic of Congo: A Persistent Challenge

Since he came to power more than four years ago, the President of the Democratic Republic of Congo, Félix Tshisekedi, has repeatedly expressed his desire to reform justice and promote the rule of law in the country. However, despite its efforts, it seems that the concept of the rule of law is struggling to establish itself in the Congolese reality.

In a recent interview, the Head of State expressed his dissatisfaction with the record of Congolese justice during his mandate. He underscored the crucial role of justice in uplifting a nation, but regretted that it instead seemed to destroy the Democratic Republic of Congo. He also deplored the lack of collaboration between the judicial institutions and his vision of reform.

President Tshisekedi has been criticized for allegedly instrumentalizing justice by using arbitrary arrests to silence dissenting opinions and political opponents. However, he denied any involvement in these proceedings and stressed that he wants the judiciary to be independent.

The observation of risky and theatrical judicial decisions

Criticisms of the judiciary are not new. In October 2022, during a meeting of the Council of Ministers, President Tshisekedi had already pointed out the apparently random judicial decisions. He stressed the importance of streamlining the action of justice to strengthen public governance and the rule of law.

President Tshisekedi had noted that Congolese justice continued to suffer from its weaknesses, contributing to widen the gap between the people and justice. He had called on the Superior Council of the Judiciary to take measures to regulate and discipline the judiciary, while preserving its constitutional independence.

Avenues for reform for more efficient justice

To remedy this situation, President Tshisekedi instructed the Minister of Justice and Keeper of the Seals to work in collaboration with the Superior Council of the Judiciary in order to propose rapid solutions. He also called on the General Inspectorate of Judicial and Penitentiary Services to play an effective role.

The Congolese President stressed that the reform of the judiciary must not compromise his independence, which is essential to ensure impartial justice for Congolese citizens. He also expressed his responsibility as Head of State in this situation, as he is accountable to the people.

In conclusion, despite President Tshisekedi’s efforts to reform the judiciary and promote the rule of law in the Democratic Republic of Congo, persistent challenges remain.. The collaboration between the judicial institutions and the necessary reforms are essential to achieve a more efficient and impartial justice in the country
