The rule of law in the Democratic Republic of Congo: a challenge for justice
Since coming to power more than four years ago, Congolese President Félix Tshisekedi has placed justice reform at the heart of his political agenda. However, despite its efforts, the rule of law is struggling to establish itself in the country.
In a recent interview, President Tshisekedi expressed his disappointment with his government’s record on justice. He deplores the fact that justice in the DRC does not live up to his expectations and believes that the current judicial system is destroying the country rather than uplifting it. He also underlines the lack of harmony between his vision and that of the heads of judicial institutions.
The Congolese president, however, defends himself from any interference in judicial decisions, declaring that he has never asked for the arrest or the release of anyone. He wants the judiciary to be independent and believes that reforms are necessary to improve its functioning.
Criticisms of the judiciary are not new. In October 2022, during a meeting of the Council of Ministers, President Tshisekedi had already expressed his concern over judicial decisions that seemed arbitrary. He had called for a rationalization of the action of justice and an improvement in its governance.
It is undeniable that problems persist within the Congolese judicial system. Judicial decisions are often perceived as random and dramatized, which undermines people’s trust in justice. In addition, critics point to arbitrary arrests and attacks on freedom of expression.
President Tshisekedi recognizes these dysfunctions and calls for rapid action to remedy them. He asked the Superior Council of the Judiciary to take measures aimed at regulating and disciplining the judiciary. He would like the General Inspectorate of Judicial and Penitentiary Services to also play a more effective role.
The reform of justice in the DRC is a major challenge for the establishment of a solid rule of law. It is essential to guarantee the independence and impartiality of the judiciary, while ensuring that the fundamental rights of citizens are respected. Only a reformed and effective justice can contribute to the advent of a prosperous and stable country.
