Fraud of Chinese leaders using a nominee driver to cover their operations
In a recently revealed case, the senior management of the Private Sector Subcontracting Regulatory Authority (ARSP) uncovered a blatant case of fraud involving the Chinese executives of CCECAS. The latter are accused of having used their driver as a fictitious fourth shareholder to conceal their operations within the framework of a partnership contract with the companies Tenke Fungurume Mining and Kisanfu, subsidiaries of the CMOC group.
The investigation carried out by the judicial police officers of the ARSP revealed that out of the 27 million dollars paid to the subcontracting company, the Chinese shareholders only handed over the modest sum of 680,000 Congolese Francs to their co -Congolese shareholder. This discovery led the General Management of the ARSP to transfer the file to the Public Prosecutor’s Office so that legal proceedings could be initiated against the Chinese leaders involved in this fraud.
This case highlights the fraudulent practices of certain economic operators who seek to circumvent the rules to maximize their profits to the detriment of Congolese shareholders. It also stresses the importance of strict regulation in the subcontracting sector in order to avoid such abuses.
The offenses of breach of trust, forgery in writing and use of forgery were retained against the Managing Director of the Chinese company, Mr. Fuu. The authorities of the ARSP also noted indications of money laundering in this case, where the payments would have been made from abroad, without leaving traces in the local banks.
This first call by the ARSP should serve as an example for all economic operators involved in fraudulent practices. This is an important step in the fight against corruption and corporate mismanagement in the Democratic Republic of Congo.
It is essential that the authorities maintain pressure on these cases of fraud and prosecute those responsible. This will send a strong signal to other companies that may be tempted to adopt similar practices.
