“Claudine Masamba’s legal fight: the quest for justice to recover her heritage held hostage”

Title: “Claudine Masamba’s legal fight to recover her inheritance: the episode that knows no end”

Introduction :

The soap opera of the hostage taking of Claudine Masamba’s legacy by her brothers continues to be talked about. Since December 2022, this case has been brought before the Tribunal de Grande Instance of Kinshasa/Matete, but despite postponements and various attempts to block the proceedings, no significant progress has been made. In this article, we will come back to the details of this case and the issues behind it.

The background of the case:

It all started with the denunciation of Claudine Masamba concerning the illicit sale of an inheritance, a plot located at number 1283 of the avenue de la Poste, in Kinshasa. This sale, worth 700,000 US dollars, was allegedly carried out by six of his brothers, all heirs of the famous Simon Masamba Makela, founder of the Masamba schools in Kinshasa. Claudine Masamba, believing she was wronged, therefore decided to sue her brothers to recover her inheritance and get out of joint ownership.

Obstacles and dilatory maneuvers:

Since the beginning of the case, many obstacles and delaying maneuvers have been put in place to hinder the procedure. First, during the December 2022 hearing, it was revealed that Claudine Masamba’s brothers residing abroad were not properly informed of the procedure, which required regularization of service. Then, during the April 2023 hearing, the alleged non-significance of one of the brothers, Rémy Masamba, was raised, which further delayed the case.

Recent twists:

During the July 2023 hearing, a new element was brought to the case. Alidor Masamba, one of Claudine’s brothers, brandished a notice of appeal from the Kinshasa/Matete Court of Appeal, claiming that he had never been duly seized by the court. However, this contradicts the contradictory service that was made in the previous hearing. This situation raises questions about the real intentions of Claudine Masamba’s brothers and about a possible desire to sell off all the property of the Masamba estate for their sole benefit.

Claudine Masamba’s reactions:

Claudine Masamba, supported by her lawyers, denounces these delaying maneuvers and affirms that her share of the inheritance is taken hostage by her brothers. She also suspects the existence of an influential dark hand that seeks to keep the situation as it is. To assert her rights, she mobilized the institutions of the Republic and quickly raised her voice to denounce this injustice.

Conclusion :

Claudine Masamba’s legal battle to recover her inheritance is far from over. Despite the attempts to block the procedure and the obstacles encountered, she remains determined to have her rights respected.. This case raises questions about justice and the protection of heir rights in the Democratic Republic of Congo. Hopefully the truth will come out and justice will be served in this complex case.
