The case between reinstated Edo Deputy Governor Philip Shaibu and Godwins Omobayo has been in the spotlight this week with the fixing of a date for hearing on a count of contempt.
The Federal High Court in Abuja has fixed October 24 to hear the contempt charge filed by Shaibu’s legal team against Godwins Omobayo for allegedly refusing to comply with a court judgment.
Justice James Omotosho ordered that all court documents, including Form 49, filed on September 19, be served on Omobayo to enable him defend himself against the contempt charge.
Shaibu’s lawyer said several attempts had been made to get Omobayo to comply with the court judgment delivered on July 17, but to no avail. Despite Shaibu’s reinstatement as Deputy Governor of Edo, Omobayo continued to hold the office.
Furthermore, the suit filed by the Edo State Government and the House of Assembly challenging Shaibu’s reinstatement was dismissed by Justice Omotosho. The latter also ordered the State and the Assembly to pay costs of N200,000 each.
The State and the Assembly’s plea to withdraw the pending suits was accepted due to the ongoing appeal before the Court of Appeal.
However, Shaibu’s counsel sought a fine of N50 million from each of the respondents but the judge ruled in favour of a total fine of N400,000.
This case arose from the nullity of Shaibu’s removal from office as Deputy Governor of Edo by the House of Assembly. The judgment was delivered in a trial where he was the plaintiff.
