The importance of Judicial Service Commission reform to ensure judicial independence

The need for reform within the Judicial Service Commission, raised by retired Justice Robert Nugent, highlights a critical issue for strengthening judicial independence in South Africa. In a webinar hosted by the Centre for Development and Enterprise (CDE), Justice Nugent stressed the imperative of eliminating any form of “political manoeuvring” within the Commission.

Unfortunately, the current process for selecting judges by the Judicial Service Commission is often criticised for its lack of objectivity and experience. The composition of the Commission, composed of 23 members including representatives of the National Assembly, the National Council of Provinces and the legal world, raises questions. Justice Nugent proposes a review of this composition, considering that the number of political appointments is no longer adapted to the current reality. He insists on the need to have members of integrity and qualifications to conduct thorough investigations on the competence of potential judges.

The politicization of the judicial appointment processes was highlighted during controversial interviews for positions at the Constitutional Court, where political issues were raised, jeopardizing the integrity of the process. It is crucial to ensure that individuals sitting on the Commission do not represent political interests, but act in the national interest and make their decisions independently.
