Lawyers plead for provisional release of defendants in Kinshasa coup case

The Kinshasa military court recently sat in a mobile court in the Ndolo military prison to examine the case related to the attempted coup d’état. A crucial decision is to be rendered this Monday, August 12, 2024, concerning the requests for provisional release submitted by the lawyers of the defendants, including Jean-Jacques Wondo and Ephraïm Mugangu Ndhirhuhirwa. Major issues weigh on this case that has shaken public opinion and fueled debates on national security and justice in the Democratic Republic of Congo.

Jean-Jacques Wondo’s lawyers argued convincingly for their client’s provisional release, highlighting the deterioration of his health. With the support of a medical report from the Ndolo military prison hospital, they stressed the need to transfer their client to an adequate hospital. This request for transfer is part of a logic of guaranteeing appropriate medical care to a defendant whose precarious health requires special attention.

On the other hand, Ephraïm Mugangu Ndhirhuhirwa’s lawyers argued to hold his wife as bail and thus allow this father to take care of his minor children, abandoned since the events of May 19. They stressed the fact that Ephraïm Mugangu presents no risk of flight and deserves to be released to assume his family responsibilities.

Faced with these requests, the prosecutor of the public prosecutor’s office put forward a firm argument, emphasizing the seriousness of the charges brought against the defendants, in particular the attempted coup d’état and the accusations of terrorism. The question of the death penalty, lifted in March 2024, underlines the importance of the issues related to this case, with potentially serious consequences for the accused.

This complex case highlights the challenges facing the Congolese justice system, between guaranteeing the rights of the defendants and preserving public order. The role of the Kinshasa military court in this case is crucial, and the upcoming decision will have significant repercussions on the conduct of the trial and the outcome of this case.
