Israel defends itself against South Africa’s genocide charges

South Africa filed suit at the International Court of Justice last Friday, accusing Israel of genocide against Palestinians in Gaza and asking the court to order Israel to stop its attacks.

Israeli government spokesman Eylon Levy called the accusations “defamation” and said Israel would appear before the ICJ in The Hague to refute the allegations.

According to Levy, this case is based neither on facts nor on legal grounds.

South African support for the Palestinians

South Africa has strongly criticized Israel since the war began on October 7.

This referral to the ICJ by South Africa is only the latest in a series of actions taken by the South African government against Israeli attacks in Gaza.

South Africa says Israel is violating the UN Genocide Convention and calls for expedited hearing.

According to Article 2 of the Genocide Convention, genocide consists of acts committed with “the intent to destroy, in whole or in part, a national, ethnic, racial or religious group.”

Both South Africa and Israel, as members of the United Nations, are bound by the decisions of the ICJ.

Ignoring ICJ decisions

If the Court issues an injunction ordering a halt to attacks in Gaza, Israel could be required to comply with the ruling.

Although the ICJ is the highest court of the United Nations, not all decisions have been followed because it does not have the means to apply them.

In March 2022, Russia ignored an order to end its military campaign in Ukraine.

In this case, it is important to wait for the next steps in this case and see how the ICJ will handle the accusations against Israel.

It is also necessary to objectively analyze the evidence presented by South Africa and Israel’s defensive arguments to form an informed opinion on this matter.

Ultimately, only the ICJ will have the power to make a final decision and we will have to wait patiently for the results of this procedure to see whether Israel will be found guilty of genocide or not. In the meantime, we must continue to closely monitor developments and support peaceful solutions to end conflicts in the Middle East.
