Article: Rehabilitation of Aimé Matamba, Director General of the General Directorate of Revenue of Kasaï Oriental
The Court of Appeal of Kasai Oriental has rendered an important verdict concerning the suspension of the Director General of the Directorate General of Revenue of Kasai Oriental, Aimé Matamba. According to a decree published on November 7, the Court decided to rehabilitate Mr. Matamba in his functions. This decision follows the invalidation of the suspension order issued by Julie Kalenga Kabongo, governor of the province.
In its judgment, the Court of Appeal emphasizes that the order suspending Mr. Matamba does not comply with the legal provisions in force. Indeed, article 13 of provincial decree n°01/0019/CAB.PROGOU/K.OR/2022 stipulates that any suspension measure must be accompanied by the opening of disciplinary action within five days. However, in the case of Mr. Matamba, the disciplinary action was not initiated within the stipulated time frame, thus rendering the suspension order null and void.
This rehabilitation of Mr. Matamba also comes at a time when new managers have been appointed to the General Directorate of Revenue of Kasaï Oriental. This appointment, which was made on November 6, marks a turning point in the management of this important revenue collection service.
It should be recalled that the preventive suspension of Mr. Matamba was decided following the conclusions of a monitoring and evaluation mission of revenue collection at the DGRKOR. This suspension also affected other officials, namely Thérèse Mitongo Nsana, Director in charge of non-tax revenue, and Patrick Tshikunga wa Mpoyi, Director in charge of tax revenue.
The rehabilitation of Mr. Matamba by the Kasai Oriental Court of Appeal shows the importance of strict compliance with legal procedures and fairness in the management of public affairs. Hopefully this will restore the confidence of agents of the General Directorate of Revenue of Kasaï Oriental and guarantee better efficiency in revenue collection.
