Rehabilitation of Godé Mpoy by the Court of Appeal of Kinshasa/Gombe
In a surprising decision, the Kinshasa/Gombe Court of Appeal recently rehabilitated Godé Mpoy, former president of the Kinshasa provincial assembly. This decision has created some confusion among elected officials in Kinshasa, who do not understand why Mpoy insists on returning to his functions despite his recent period of medical leave.
Indeed, following a motion for forfeiture filed by several elected officials, Godé Mpoy was forced to take a 45-day intellectual rest, as recommended by his attending physician. However, barely rehabilitated by the Court of Appeal, Mpoy asked Francis Tshibalabala, interim president of the provincial assembly of Kinshasa, to send the APK files to his home.
This request was perceived as strange by the elected representatives of Kinshasa, given that Mpoy had not responded to the plenary’s invitation to present his defenses. Furthermore, the Court of Appeal has not yet officially notified the APK office of Mpoy’s rehabilitation, which raises doubts about the legitimacy of his request.
The interim president of the APK, Francis Tshibalabala, responded to Mpoy by denying the existence of the judgment of the Court of Appeal rehabilitating him. He also points out that Mpoy should still rest during his 45-day recovery period, as recommended by his doctor.
This situation perplexes the elected representatives of Kinshasa, who believe that the rehabilitation of Mpoy by the Court of Appeal is a fruitless act as long as he does not provide the evidence justifying his reinstatement. In the meantime, the interim president of the APK will continue to be ensured in accordance with the rules in force.
It is clear that the Godé Mpoy soap opera is far from over and the next episodes promise to be as tumultuous as the previous ones. Kinshasa’s elected officials are awaiting clarification and tangible evidence from Mpoy before considering a possible resumption of his functions at the head of the Kinshasa provincial assembly.
