Rule of law in the DRC: between aspirations and reality

The rule of law is a fundamental concept that advocates equality before the law, respect for human rights and the guarantee of an independent and impartial judicial system. In theory, the Democratic Republic of Congo (DRC) is committed to promoting and consolidating the rule of law. But what about in practice?

According to Thomas Fessy, senior researcher at Human Rights Watch, although many slogans tout the restoration of the rule of law in the DRC, the reality is quite different. Arbitrariness remains predominant and human rights are regularly violated. An opinion shared by some observers who see a glass as half empty when others consider it to be half full.

Paul Nsapu, president of the National Human Rights Commission in the DRC, says he is attentive to the situation and tries to closely examine violations of the rule of law. He points out that everyone may interpret the situation differently, but it is important to recognize the challenges involved.

For the French lawyer at the Lille bar, Me Oscar Mubiayi, the rule of law is on the move in the DRC. According to him, since Felix Tshisekedi came to power, much progress has been made. To consolidate the rule of law, he advocates reforms, including constitutional changes.

However, these different perspectives raise questions about the requirements and constraints related to the rule of law in the DRC. Theory often seems to clash with reality, leaving room for contradictions that need to be resolved.

The promotion of a true rule of law in the DRC therefore requires concrete actions and political will on the part of the authorities. It is essential to strengthen the independence of the judicial system, to guarantee the protection of human rights and to fight against impunity. Legislative and institutional reforms can also contribute to creating an environment conducive to the rule of law.
