The importance of OHADA for the Democratic Republic of Congo: Advocacy for the installation of an institution in the DRC
On August 29, the Congolese Prime Minister, Jean-Michel Sama Lukonde, opened the 55ᵉ session of the Council of Ministers of the Organization for the Harmonization of Business Law in Africa (OHADA) in Kinshasa. This session brings together the Ministers of Justice of the member countries of this organization and constitutes an important opportunity to plead in favor of the installation of an institution of OHADA in the Democratic Republic of Congo.
In his speech, Prime Minister Sama Lukonde expressed his gratitude to the experts and representatives of OHADA member countries for their presence at these meetings. He underlined that the Democratic Republic of Congo fully subscribes to the vision of an Africa where economic development is favored by transparent, consistent and fair laws and regulations. OHADA embodies this vision by providing a dynamic framework that supports regional integration and fluid economic practices.
The Prime Minister also denounced the aggression of the DRC by Rwanda, underlining the disastrous consequences of this situation, in particular the massacres of civilian populations, rapes and the looting of natural resources. He affirmed that integrity, fairness and peace are essential pillars to foster economic development. In this context, OHADA plays a crucial role in promoting legal convergence and economic prosperity.
The Prime Minister’s plea in favor of the installation of an OHADA institution in the DRC reflects the country’s desire to strengthen its position in the field of business law. This approach is in line with the vision of President Félix-Antoine Tshisekedi Tshilombo, who wishes to see the DRC occupy a prominent place in the legal sector and contribute to the creation of a business-friendly environment.
It is important to remember that the objective of OHADA is to facilitate trade and investment, by guaranteeing the legal security of business activities. The harmonized law of OHADA promotes economic development and contributes to the creation of a favorable business climate.
In conclusion, the participation of the Democratic Republic of Congo in the 55ᵉ session of the OHADA Council of Ministers demonstrates the country’s commitment to the harmonization of business law in Africa. The Prime Minister’s plea for the establishment of an OHADA institution in the DRC is an important step to strengthen the country’s position in the legal field and promote economic development. OHADA plays a vital role in achieving these goals and contributes to building a more robust and diversified economy in Africa
