Jean-Claude Muyambo Kyassa, national president of the Congolese Solidarity for Democracy and Development (SCODE) political party, recently took the decision to prosecute the Attorney General at the Kinshasa/Gombe Court of Appeal, Robert Kumbu Phanzu. This decision follows the withdrawal of the wanted notice against Kalev Mutond, the former head of the National Intelligence Agency (ANR).
Muyambo expresses his dissatisfaction with this decision, affirming that it was taken without Kalev Mutond having answered in court, and without any confrontation having taken place. For him, it is essential that justice be done in this case, which concerns offenses of arbitrary arrest, illegal detention with corporal torture and extortion.
Former president of the Lubumbashi bar for three years, Muyambo Kyassa also held the post of Minister of Humanitarian Affairs in the government of Antoine Gizenga. In 2023, he announced his candidacy for the presidential election scheduled for that same year, officially leaving the Sacred Union which supports President Félix Tshisekedi.
These legal developments follow the cancellation of the wanted notice against Kalev Mutond, a decision taken by the courts on August 11. According to the judicial authorities, the reasons which justified the search notice are no longer present.
Jean-Claude Muyambo Kyassa therefore affirms his intention to sue the Attorney General to challenge this decision. He is trying to get Kalev Mutond to answer in court and that the facts of which he is accused are examined in depth.
The case of the withdrawal of the wanted notice against Kalev Mutond raises questions about the transparency and independence of the judicial system in the Democratic Republic of Congo. Muyambo Kyassa’s actions demonstrate his determination to fight for justice and defend the rights of Congolese citizens.
It remains to be seen how this case will develop and whether Jean-Claude Muyambo Kyassa’s claims will be taken into account by the judicial system
