“The release of more than a hundred suspected terrorists following dismissals: Reflections on the effectiveness of judicial investigations in the fight against terrorism”

Beninese justice recently released more than a hundred detainees accused of terrorism. This decision comes after the proceedings against them ended in dismissal. These alleged terrorists came from different countries in the sub-region, including Benin, Niger, Togo, Burkina Faso, Nigeria, Ghana and Chad.

Arrested between 2019 and 2022, these 127 individuals were detained in the civil prison of Missrété, in Benin. The Court for the Suppression of Economic Crimes and Terrorism (CRIET) accused them of belonging to a terrorist organization and had opened 94 proceedings against them. However, after thorough review, these proceedings were closed with dismissals, which led to their release.

It is important to emphasize that this release decision does not mean that the charges against these individuals were unfounded, but rather that the evidence gathered was not strong enough to justify a prosecution. Beninese justice therefore took the decision to release them, in accordance with the presumption of innocence.

It is also interesting to note that non-Beninese among the detainees will be handed over to the diplomatic representations of their countries of origin. This demonstrates the collaboration between the different nations of the sub-region in the fight against terrorism and the desire to promote international cooperation in the area of ​​justice.
