“Renewal of the oath of the Attorney General and new Advocates General at the Constitutional Court of the DRC”

On June 8, 2023, the Democratic Republic of Congo attended the renewal ceremony of the oath of the Attorney General at the Constitutional Court. This ceremony, which was held at the People’s Palace, was attended by many political and civil personalities, as well as by members of the two chambers of parliament.

Jean-Paul Mukolo, who had been renewed in office by presidential order on May 4, was the first to take the oath before the Head of State, Felix Tshisekedi. He thus renewed his commitment to respect the constitution and to fulfill his functions in a fair and impartial manner.

The ceremony was also an opportunity for three new Advocates General to the Constitutional Court to take the oath. They are Ndaka Matandombi, Bonane Biakuajiri Mona and Masiala Kaza, all appointed by presidential order dated June 6, 2023.

Organic Law No. 13/026 of October 15, 2013 on the organization and functioning of the Constitutional Court establishes a General Prosecutor’s Office attached to the Constitutional Court, placed under the authority of the General Prosecutor. The latter is assisted by the first Advocates General and Advocates General.

In criminal matters, the General Prosecutor attached to the Constitutional Court is responsible for investigating and establishing offenses within the jurisdiction of the Court. In other matters, it issues reasoned opinions and attends all Court hearings by presenting observations.

In short, this oath renewal ceremony marks the continuity of the mission of the Constitutional Court of the Democratic Republic of Congo and its members to defend the Constitution and the rule of law.
