“Publication of the provisional lists of candidates: a crucial step towards transparent elections”

The Independent National Electoral Commission (CENI) will proceed this Wednesday, August 9 to the publication of the provisional lists of candidates admissible or not for the next elections. This crucial step in the electoral process has been confirmed by an internal source of the CENI, who specifies that this is done in accordance with the established electoral calendar.

According to this same source, in the event of admissibility of the lists of candidates, the CENI will provide explanations to justify its decision. Similarly, if applications are deemed inadmissible, the reasons for this decision will also be motivated.

It is important to underline that the lists of candidates can be declared inadmissible in different situations. For example, if they include the names of ineligible persons, if they present a number of candidates greater than the number of seats fixed in each constituency, or if a candidate is present in several electoral constituencies for the same level.

It is essential to understand that the eligibility of a political party depends on the threshold of candidacies reached. Thus, a party that has presented only 200 candidates cannot claim to be eliminated by the CENI, because it has not reached the required threshold.

Once the provisional lists of candidates for the elections of national deputies have been published, a period of five days is granted for any dispute before the competent court. This dispute may be initiated by the candidate himself whose eligibility is in question, by the political party or the political group having presented a candidate or a list in the electoral constituency, or even by a candidate presenting himself individually in this same electoral constituency or his representative.

The CENI specifies that this period runs from the first working day following the publication of the provisional lists of candidates. The competent court will then have to rule as soon as possible, without additional costs and in priority, on the decisions of inadmissibility of the applications as well as on the attachments which accompany them.

In conclusion, the publication of the provisional lists of candidates by the CENI is a crucial step in the electoral process. This helps to ensure the transparency and fairness of the elections by assessing the admissibility of candidacies. Subsequent challenges before the competent court are also an additional guarantee to ensure compliance with the electoral rules
