Title: Edouard Mwangachuchu: a new request for provisional release rejected by the highest Congolese military court
The Congolese High Military Court on Tuesday rejected a new request for provisional release from MP Edouard Mwangachuchu, prosecuted for treason, participation in an insurrectionary movement and illegal possession of weapons of war.
This time, the request had been made for reasons of “precarious health”, in order to allow the defendant to go to medical appointments. The military prosecution, however, questioned the power of the Congolese judge to bring back the defendant if he was released and went abroad for treatment.
Edouard Mwangachuchu and his co-defendant are accused of having links with the M23 rebels, an armed group active in the North Kivu region. The proceedings were initiated following the discovery of weapons of war in the residence of the deputy in Kinshasa, and in the premises of his company SMB in Masisi.
This is not the first request for provisional release rejected for Edouard Mwangachuchu, who had already seen his request refused last March. The precarious security situation in some parts of the country and the alleged links with an armed militia make it difficult to obtain an early release for the defendant.
