Expulsion from Kinshasa City Hall for non-payment of rent

The Mokazu family, owners of a 4-storey building located on Province Avenue in the commune of Gombe, accuses the Kinshasa City Hall of non-payment of rent arrears for nearly 2 and a half years, s amounting to 480,000 US dollars. According to the memorandum consulted by Actu30.cd, six ministries have been installed in this building, including the provincial Ministry of Finance and that of Public Works and Infrastructure, Fisheries and Livestock.

Having tried in vain to recover the unpaid rent, the owner of the building initiated legal proceedings and obtained the termination of the lease by a judgment of the High Court of Kinshasa / Gombe under RC 123.324. She thus launched an eviction procedure from Kinshasa City Hall and demanded compensation of 20,000 US dollars, 6% legal interest per year and rent arrears.

Although the Congolese constitution guarantees the right to property, the complainant implored the intervention of the Head of State to obtain justice.

This news highlights the importance of respecting the terms of a lease contract in any type of real estate transaction, and the importance of submitting to court decisions, even for public authorities.
