The soap opera of the taking hostage of the legacy of Claudine Masamba by her brothers is a subject that continues to be talked about. Opened in December 2022 at the Tribunal de Grande Instance of Kinshasa/Matete, this case is far from closed and has given rise to many controversies.
Indeed, Claudine Masamba denounced the illicit sale of an inheritance, namely the plot located at number 1283 of the avenue de la Poste, in the town of Limete. This sale, carried out by six of his brothers, would have been carried out on the basis of false documents, such as a “Protocol of agreement of sale” and a “Compromise of sale”. Dissatisfied with this fraudulent sale, Claudine Masamba decided to take legal action to have her rights as heiress restored and to obtain the release of joint ownership.
However, the court case has been postponed several times, mainly because of delaying maneuvers aimed at blocking the procedure. In addition, defects in form and procedure were also noted. Thus, despite Claudine Masamba’s efforts, the case has not progressed in the direction of substantive discussions.
The complications began during the hearing on December 23, 2022, where it was revealed that Claudine Masamba’s brothers residing abroad had not been reached legally. It was therefore necessary to regularize the referral procedure in order to be able to progress in the processing of the file.
But the surprises didn’t stop there. During the hearing on April 18, 2023, it emerged that one of the brothers, Rémy Masamba, had allegedly escaped service, claiming to reside in Gombe, while his known address was in Limete. After four months of hesitation, he was finally reached and his presence was requested at the hearing on July 18, 2023.
However, at this hearing, Alidor Masamba, another brother of Claudine, brandished a notice of appeal from the Court of Appeal of Kinshasa/Matete, arguing that he had never been duly seized by the court. This situation called into question the referral of all the parties and brought the case back to the procedural stage.
Claudine Masamba, for her part, believes that all these delaying maneuvers are aimed at preventing her from getting out of joint ownership. She claims that her share of the inheritance is taken hostage by her brothers, without really knowing what their hidden intentions are. She also suspects the existence of a dark hand acting to keep the situation as it is, while she has requested the intervention of various institutions of the Republic to publicize the injustice of which she is the victim.
This family soap sheds light on a complex and problematic situation. Claudine Masamba deplores the scandal that is tarnishing her family’s reputation and hopes to be able to obtain justice in this case.
