The rule of law in the Democratic Republic of Congo: the challenges of judicial reform for Félix Tshisekedi
Since coming to power more than four years ago, Congolese President Félix Tshisekedi has made justice reform one of his priorities. He is convinced that the rule of law is essential for the development and stability of his country. However, despite its efforts, the establishment of the rule of law in the DRC faces many challenges.
In an interview with his spokesperson, Tina Salama, Felix Tshisekedi expressed his frustration with his government’s record on justice. He recognizes that Congolese justice is far from meeting expectations and deplores the dysfunctions observed in its functioning.
The Congolese president denies any intervention in judicial affairs and claims to want to guarantee the independence of justice. However, many voices are raised to accuse him of instrumentalising justice for political ends, by carrying out arbitrary arrests or by manipulating certain judicial decisions.
One of the main criticisms addressed to Congolese justice is the impression of arbitrariness that surrounds certain decisions. Many judicial actors act haphazardly and dramatize justice, which creates a gap of mistrust between the people and the judicial system.
To remedy this situation, Félix Tshisekedi asked for reforms to the Superior Council of the Judiciary and to the General Inspectorate of Judicial and Penitentiary Services. He would like these bodies to ensure effective and disciplinary regulation of the judiciary, while respecting the constitutional independence of the judiciary.
Justice reform in the DRC is a complex challenge. It requires a strong commitment from the authorities to guarantee the independence of justice, fight against corruption and improve the efficiency of the judicial system. This also implies adequate training of magistrates, better management of resources and increased awareness of the importance of the rule of law.
Félix Tshisekedi is aware of the challenges that await him and says he is determined to continue his efforts to reform Congolese justice. He sees justice as essential to uplifting the nation and wants his record in this area to improve before the end of his term.
