The rule of law in the Democratic Republic of Congo: a persistent challenge
Since taking office more than four years ago, the President of the Democratic Republic of Congo, Félix Tshisekedi, has repeatedly expressed his desire to reform the judicial system and promote the rule of law. However, despite these stated ambitions, it is clear that the path to establishing a solid and independent judicial system remains strewn with pitfalls.
In a recent interview, President Tshisekedi admitted his disappointment with the record of justice during his tenure. He deplores the fact that justice in the DRC does not play its role effectively and that certain judicial decisions seem to be taken randomly, thus fueling mistrust between the people and the judicial system.
President Tshisekedi has also been accused of instrumentalizing justice to suppress critical voices against him and to eliminate opponents. However, he denies any involvement in the arrests and releases, claiming to want to preserve the independence of justice.
It is clear that reforms are needed to improve the functioning of justice in the DRC. President Tshisekedi called on the Superior Council of the Judiciary to play its role in the administrative and disciplinary regulation of the judiciary. He also asked the General Inspectorate of Judicial and Penitentiary Services to fulfill its role effectively.
Despite these efforts, it is crucial to underline that the independence of the judiciary is essential to ensure a real reform of the judicial system. Judicial institutions must be able to exercise their power without interference from the hierarchy or political power. This will ensure impartial justice and build people’s confidence in the justice system.
In conclusion, although efforts have been made to reform the judicial system and promote the rule of law in the DRC, it is necessary to put in place concrete measures to guarantee the independence of justice and ensure a more efficient functioning of justice in the country.
